Schwangere und stillende Frauen sollen im Rahmen des Mutterschutzgesetzes vor Gefahren am Arbeitsplatz bewahrt werden, die Mutter oder Kind schädigen können. Das Mutterschutzgesetz ist anwendbar, wenn ein Beschäftigungsverhältnis besteht oder die Frauen bestimmten Personengruppen angehören, z. B. in Heimarbeit Beschäftigte (Heimarbeiter) gegeben ist.

Der Mutterschutz umfasst vor allem betriebliche Beschäftigungsverbote vor und nach der Entbindung.

Der Arbeitgeber hat sicherzustellen, dass eine schwangere oder stillende Frau bestimmte Tätigkeiten nicht ausübt und bestimmten Arbeitsbedingungen nicht ausgesetzt ist, weil diese für sie oder ihr Kind eine unverantwortbare Gefährdung darstellen. Der Arbeitgeber darf eine schwangere Frau beispielsweise keine Tätigkeiten ausüben lassen, bei denen sie schwer körperlich arbeiten (z. B. regelmäßiges Heben und Tragen von Lasten mit mehr als fünf Kilogramm Gewicht) oder Akkordarbeit verrichten müssen. Schwangere und stillende Frauen darf der Arbeitgeber keine Tätigkeiten ausüben lassen und Arbeitsbedingungen aussetzen, bei denen sie einer unverantwortbaren Gefährdung durch Gefahr- oder Biostoffe ausgesetzt sind.

Auch für die Zeit nach der Entbindung bestehen gewisse betriebliche Beschäftigungsverbote. So darf z. B. eine Wöchnerin bis zum Ablauf von acht Wochen nach der Entbindung nicht beschäftigt werden (Schutzfrist nach der Entbindung). Bei Früh- oder Mehrlingsgeburten darf die Mutter bis zum Ablauf von zwölf Wochen nicht beschäftigt werden. Derselbe Zeitraum gilt in Fällen, in denen vor Ablauf von acht Wochen nach der Entbindung bei dem Kind eine Behinderung im Sinne von § 2 Absatz 1 Satz 1 Sozialgesetzbuch IX ärztlich festgestellt und eine Verlängerung der Schutzfrist von der Mutter bei ihrer Krankenkasse beantragt wird. Die Schutzfrist nach der Geburt verlängert sich bei Frühgeburten und sonstigen vorzeitigen Entbindungen zusätzlich um den Zeitraum, der von der Schutzfrist vor der Geburt nicht in Anspruch genommen werden konnte.

Daneben umfasst der Mutterschutz auch ärztliche Beschäftigungsverbote. Eine schwangere Frau darf nicht beschäftigt werden, soweit nach ärztlichem Zeugnis Leben oder Gesundheit von Mutter oder Kind bei Fortdauer der Beschäftigung gefährdet ist.

Freizeit ist zur Durchführung der Untersuchungen im Rahmen der Mutterschaftshilfe zu gewähren. Durch die Beschäftigungsverbote und Freizeitgewährung darf ein Entgeltausfall nicht eintreten.

Auch die Lage und Dauer der Arbeitszeit ist eingeschränkt. So darf eine schwangere oder stillende Frau in der Regel nicht zur Nachtzeit zwischen 20 und 6 Uhr, nicht an Sonn- und Feiertagen (Feiertagsarbeit) sowie grundsätzlich nicht über achteinhalb Stunden täglich beschäftigt werden.

Kehrt eine schwangere oder stillende Frau nach dem Ende eines Beschäftigungsverbots in den Betrieb zurück, hat sie das Recht, entsprechend den vertraglich vereinbarten Bedingungen beschäftigt zu werden.

Es bestehen auch finanzielle Ansprüche. In Betracht kommen die Entgeltfortzahlung bei Beschäftigungsverboten, die Gewährung von Mutterschaftsgeld und Mutterschaftshilfe.

Im Rahmen des Kündigungsschutzes darf einer Frau während der Schwangerschaft, bis zum Ablauf von vier Monaten nach einer Fehlgeburt nach der zwölften Schwangerschaftswoche und bis zum Ablauf von vier Monaten nach der Entbindung nicht gekündigt werden. Voraussetzung ist, dass dem Arbeitgeber zur Zeit der Kündigung die Schwangerschaft, die Fehlgeburt nach der zwölften Schwangerschaftswoche oder die Entbindung bekannt ist oder ihm innerhalb von zwei Wochen nach Zugang der Kündigung mitgeteilt wird. Das Überschreiten dieser Frist ist unschädlich, wenn es auf einem von der Frau nicht zu vertretenden Grund beruht und die Mitteilung unverzüglich nachgeholt wird. Dieser besondere Kündigungsschutz gilt auch für eine im Familienhaushalt beschäftigte Arbeitnehmerin.

In besonderen Fällen, die nicht mit dem Zustand der Frau in der Schwangerschaft, nach einer Fehlgeburt nach der zwölften Schwangerschaftswoche oder nach der Entbindung im Zusammenhang stehen, kann die Aufsichtsbehörde die Kündigung ausnahmsweise für zulässig erklären.

Das Mutterschutzgesetz verpflichtet den Arbeitgeber, eine Beurteilung der Arbeitsbedingungen vorzunehmen und alle Beschäftigten über die Ergebnisse der Beurteilung sowie die notwendigen Schutzmaßnahmen zu informieren.

Wird Elternzeit in Anspruch genommen, darf der Arbeitgeber das Arbeitsverhältnis während der Elternzeit nicht kündigen.

Die Mutter kann unter Einhaltung einer Kündigungsfrist von drei Monaten zum Ende ihrer Elternzeit kündigen, soweit für sie nicht eine kürzere gesetzliche oder vereinbarte Kündigungsfrist (Kündigungsschutz) gilt.

Die Zeit der Mutterschutzfrist wird als Anrechnungszeit in der Rentenversicherung berücksichtigt, wenn die Schwangerschaft eine versicherungspflichtige Beschäftigung unterbrochen hat. Liegt die Mutterschutzfrist zwischen dem vollendeten 17. und dem vollendeten 25. Lebensjahr der Mutter, so wird sie auch ohne Unterbrechung einer versicherungspflichtigen Beschäftigung als Anrechnungszeit berücksichtigt (Sozialgesetzbuch VI)
